Terms of Use

The terms governing your download, access to, and use of DOER across supported Apple devices.

These Terms of Use ("Terms") govern your download, access to, and use of DOER- Simple To Do List ("DOER" or the "App"), provided by Presage42 ("Presage42," "we," "us," or "our").

Please read these Terms carefully. By downloading, accessing, or using DOER, you agree to these Terms. If you do not agree, do not use the App.

1. Who May Use DOER

You may use DOER only if you are legally permitted to enter into these Terms in your country or region.

DOER is a general-audience productivity application. It is not specifically directed to children and is not designed as a children-focused app.

If you are under the age required by applicable law to enter into these Terms or consent to data processing, you may use the App only with the involvement, permission, and supervision of a parent or legal guardian. By using the App, you represent that you have the legal capacity to agree to these Terms or that your parent or legal guardian has agreed to them on your behalf. The parent or guardian is responsible for the minor's use of the App.

You must comply with all laws and regulations that apply to your use of DOER.

2. Apple App Store Terms

DOER is distributed through Apple's App Store. Your use of the App is also subject to the applicable Apple Media Services Terms and Conditions and Apple's Licensed Application End User License Agreement (the "Apple Standard EULA"), available at apple.com/legal/internet-services/itunes/dev/stdeula.

These Terms supplement the Apple Standard EULA. If these Terms conflict with mandatory Apple terms governing your App Store license or purchase, the applicable Apple terms will control to the extent of that conflict.

These Terms are between you and Presage42, not Apple. Presage42, and not Apple, is responsible for the App and its content, maintenance, and support, except to the extent applicable law or Apple's terms provide otherwise. Apple has no obligation to provide maintenance or support for DOER.

Apple and its subsidiaries are intended third-party beneficiaries of the provisions concerning your license to use the App. Upon your acceptance of these Terms, Apple may enforce those provisions against you as a third-party beneficiary.

3. License to Use the App

Subject to these Terms and the Apple Standard EULA, Presage42 grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to use DOER on Apple-branded devices that you own or control, as permitted by Apple's applicable usage rules, including any permitted Family Sharing or volume-purchasing arrangements.

The App is licensed, not sold. Presage42 and its licensors retain all rights not expressly granted to you.

You may not, except where applicable law expressly permits it:

  • Copy, distribute, sell, lease, sublicense, or commercially exploit the App
  • Reverse engineer, decompile, disassemble, or attempt to derive the App's source code
  • Modify, translate, adapt, or create derivative works based on the App
  • Remove or alter copyright, trademark, or other proprietary notices
  • Bypass, disable, or interfere with security, access, purchase, or feature restrictions
  • Use the App to build or assist a competing product through unauthorized extraction or reproduction
  • Make the App available over a network for simultaneous use in a manner not permitted by Apple

4. Your Content

DOER allows you to create tasks, subtasks, notes, recordings, and other content and to attach photos, videos, audio, documents, archives, and other files (collectively, "User Content").

You retain ownership of your User Content. These Terms do not transfer ownership of your User Content to Presage42.

You give Presage42 only the limited rights technically necessary to process User Content through the App for purposes such as storing it on your device, displaying it, creating notifications and Live Activities, synchronizing it through your private iCloud/CloudKit database, and carrying out actions you request.

You are solely responsible for your User Content and must ensure that:

  • You own it or have permission to use it
  • Its creation, storage, and use do not violate law or another person's rights
  • It does not contain malware or code intended to disrupt a device or service
  • You do not use the App to threaten, harass, defame, exploit, or unlawfully harm another person

DOER does not require you to enter sensitive or confidential information. You should consider carefully before placing health information, financial information, credentials, trade secrets, or other sensitive material in tasks or attachments.

5. App Functionality

DOER provides tools for task management, focus sessions, completion history, productivity statistics, attachments, notifications, widgets, Live Activities, exports, and supported-device synchronization.

Some features depend on:

  • A compatible Apple device and supported operating-system version
  • An active Apple Account and available iCloud storage
  • Internet access for iCloud synchronization
  • Permissions for notifications, camera, microphone, photos, or files
  • Apple services such as CloudKit, WidgetKit, ActivityKit, and StoreKit

Features may work differently across iPhone, iPad, Mac, Apple Watch, widgets, and other Apple interfaces. Some features may not be available in every country, language, device, or operating-system version.

DOER is a productivity tool. It does not guarantee that tasks will be completed, deadlines will be met, notifications will be delivered at an exact time, or synchronized information will always be immediately available on every device.

You should not rely on DOER as the sole system for emergency reminders, medical instructions, safety-critical activities, legal deadlines, financial obligations, or other situations where a missed task or notification could cause serious harm.

6. Storage, Synchronization, and Backups

App content may be stored locally on your device and, when available, synchronized through the private CloudKit database connected to your Apple Account.

Synchronization is provided through Apple services and may be delayed, interrupted, or unavailable because of network conditions, iCloud settings, storage limits, service outages, account status, software updates, or other circumstances outside Presage42's control.

You are responsible for maintaining access to your devices and Apple Account and for keeping independent copies of information that you cannot afford to lose. Removing the App from one device may not remove synchronized data from iCloud or your other devices.

7. Notifications and Lock Screen Visibility

If enabled, DOER may display task text and focus-session information in notifications, widgets, Live Activities, Dynamic Island, Apple Watch, or on the Lock Screen.

This information may be visible to people near your device, including while the device is locked. You are responsible for choosing suitable task text and configuring notification previews and permissions in your device settings.

8. Exports and Third-Party Services

When you use Apple's system share sheet or another export feature, you choose the destination for the exported information. Once information is transferred to another app, person, or service, its use is governed by that recipient's terms and privacy practices.

DOER may include links to Apple or other third-party services. Presage42 does not control and is not responsible for the availability, content, security, or practices of third-party services. Your use of those services is at your own discretion and subject to their terms.

9. Purchases, Subscriptions, and Trials

DOER may offer paid features, an auto-renewing subscription, a free trial, a one-time purchase, or a lifetime-access option. An offer applies only when it is displayed as available in the App and confirmed through Apple's purchase interface.

If a paid offer is available:

  • The price, currency, billing period, trial period, and included features will be shown before you confirm the purchase.
  • Purchases are processed by Apple using the Apple Account and payment method connected to the App Store. Presage42 does not receive your full payment-card details.
  • Taxes and currency conversion may apply according to your country or region and Apple's rules.
  • An auto-renewing subscription renews for the displayed period unless you cancel it through your Apple Account before the renewal date.
  • If a free trial converts into a paid subscription, the price shown at confirmation will be charged unless you cancel before the trial ends.
  • Deleting DOER does not cancel a subscription.
  • After cancellation, subscription access normally continues until the end of the current paid period unless Apple or applicable law provides otherwise.
  • You can manage or cancel subscriptions through your Apple Account's subscription settings.
  • Eligible purchases may be restored using the Apple Account that made the purchase, subject to Apple's rules and technical availability.

A "lifetime" or "one-time" purchase means access to the purchased App features for the operational lifetime of DOER under the Apple Account that made the purchase. It does not guarantee that the App, a particular feature, or compatibility with future devices and operating systems will remain available forever. Mandatory consumer rights remain unaffected.

Apple handles App Store billing and refund requests. Refund eligibility is determined by Apple and applicable law. You may request an eligible refund through reportaproblem.apple.com.

If no paid offer is active in the App, paywall screens, prices, trials, or purchase buttons shown in a preview or demonstration do not create a charge or entitlement until an actual purchase is confirmed through Apple.

10. Updates and Changes to the App

We may release updates that add, change, or remove features, fix issues, improve security, or maintain compatibility with Apple platforms.

We may modify, suspend, or discontinue all or part of DOER when reasonably necessary, including because of security concerns, legal requirements, platform changes, technical limitations, or business decisions. Where reasonably possible and required by law, we will provide appropriate notice of material changes.

We do not guarantee that the App will support every future device or operating-system version.

11. Intellectual Property

DOER, including its software, design, interfaces, graphics, branding, logos, animations, text supplied by Presage42, and other non-user content, is owned by or licensed to Presage42 and is protected by applicable intellectual-property laws.

"DOER," "DOER- Simple To Do List," Presage42 branding, and associated visual elements may not be used in a manner that suggests sponsorship, endorsement, or affiliation without prior written permission.

If you send us suggestions, ideas, or feedback, you allow us to use them without restriction or compensation, provided we do not publicly identify you as the source without your permission.

12. Support

You may contact us at hello@presage42.com for support concerning DOER.

We aim to provide reasonable support but do not guarantee a particular response time or that every issue can be resolved. Apple is not responsible for providing maintenance or support for the App.

13. Suspension and Termination

You may stop using DOER at any time. You are responsible for canceling any active subscription separately through your Apple Account.

Your license may terminate automatically if you materially violate these Terms. We may also restrict access to features under our control when reasonably necessary to address fraud, unlawful conduct, security risks, or misuse.

Upon termination, you must stop using the App. Provisions that by their nature should survive termination—including provisions concerning ownership, payment obligations, disclaimers, liability, and disputes—will remain in effect.

14. Disclaimer of Warranties

To the maximum extent permitted by applicable law, DOER is provided "as is" and "as available." Presage42 does not guarantee that the App will be uninterrupted, error-free, completely secure, compatible with every device, or free from data loss or synchronization delays.

To the maximum extent permitted by law, we disclaim implied warranties, including merchantability, satisfactory quality, fitness for a particular purpose, quiet enjoyment, and non-infringement.

Some countries or regions do not permit certain warranty exclusions. In those places, these exclusions apply only to the extent legally permitted. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

If the App fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, as provided by Apple's terms and applicable law. To the maximum extent permitted by law, Apple has no other warranty obligation concerning DOER.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Presage42 will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, revenue, business opportunity, goodwill, or productivity arising from or related to your use of or inability to use DOER.

To the maximum extent permitted by law, Presage42's total liability for claims relating to DOER will not exceed the greater of:

  • The amount you paid for DOER during the twelve months before the event giving rise to the claim; or
  • Fifty United States dollars (USD 50)

These limitations do not apply to liability that cannot legally be limited, including any mandatory liability for fraud, intentional misconduct, gross negligence, personal injury, or non-waivable consumer rights where applicable.

16. Intellectual-Property Claims

If a third party claims that DOER or your permitted use of it infringes that party's intellectual-property rights, Presage42—not Apple—will be responsible for investigating, defending, settling, or otherwise handling the claim to the extent required by these Terms and applicable law.

To report a claimed infringement concerning DOER, contact hello@presage42.com and provide sufficient information for us to understand the claim.

17. Export and Sanctions Compliance

You may not use, export, or re-export the App in violation of applicable export-control or sanctions laws. You represent that you are not prohibited from receiving or using the App under applicable trade restrictions.

You must not use DOER for purposes prohibited by applicable law.

18. Governing Law and Disputes

Unless mandatory consumer law provides otherwise, these Terms and disputes between you and Presage42 concerning DOER are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules.

Before starting formal proceedings, you and Presage42 agree to make a reasonable good-faith effort to resolve the issue by contacting the other party. You can contact us at hello@presage42.com.

To the extent permitted by law, disputes arising from these Terms will be submitted to the competent courts of Türkiye. If mandatory law gives you the right to bring a claim in your place of residence or another forum, this section does not take away that right.

The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

19. Changes to These Terms

We may update these Terms to reflect changes to DOER, Apple platform requirements, business practices, or applicable law.

The updated Terms will display a revised "Last Updated" date. If a change materially affects your rights, we will provide additional notice where required by law. Your continued use of DOER after updated Terms take effect constitutes acceptance to the extent permitted by law.

20. General Terms

If any provision of these Terms is found unenforceable, it will be enforced to the greatest extent permitted and the remaining provisions will remain in effect.

Our failure to enforce a provision is not a waiver of our right to enforce it later.

You may not transfer your rights or obligations under these Terms without our prior written consent. We may transfer these Terms as part of a merger, acquisition, reorganization, sale of assets, or transfer of responsibility for DOER, subject to applicable law.

These Terms, the Privacy Policy, and the applicable Apple terms constitute the agreement governing your use of DOER, except where additional terms are presented for a specific feature or offer.
